TERMS OF USE (DISTANCE SALES AGREEMENT)

Pursuant to the “Regulation on the Procedures and Principles for the Implementation of Distance Contracts” published in the Official Gazette dated 13.06.2003 and numbered 25137, an obligation to conclude a contract has been introduced for sales made over the internet. The contract details are as specified below.

Sales Agreement

ARTICLE 1 – PARTIES

1.2 BUYER Title / Name, Surname: Address: Phone: E-Mail: (Your Address, Phone, E-Mail information will be added to the contract in the format you specify during the order phase, in addition to your relevant information in the previously concluded fair participation agreement.)

ARTICLE 2 – SUBJECT

The subject of this contract is the determination of the rights and obligations of the parties regarding the sale and delivery of the service ordered by the BUYER electronically from the SELLER’s website, the characteristics and sales price of which are specified in the invoice details, in accordance with the provisions of the Law on the Protection of Consumers numbered 4077 and the Regulation on the Procedures and Principles for the Implementation of Distance Contracts.

ARTICLE 3 – PRODUCT SUBJECT TO THE CONTRACT

The products are the services of providing power cabling for exhibition stands, water line connection, pressurized air connection, and ADSL line connection, as well as the sale of carpets, specific to the exhibitors of the Bosphorus Boat Show Exhibition.

The type, kind, quantity, sales price, and payment method of the services and products are as stated in the sales invoice. Delivery shall be realized on the date of February 17, 2024, at the latest, in a manner that allows the BUYER to use the service at the Bosphorus Boat Show Land Exhibition, which will be held at the Istanbul Expo Center between February 17-24, 2024.

ARTICLE 4 – GENERAL PROVISIONS

4.1 – The BUYER declares that they have read and understood the preliminary information regarding the basic qualities, sales price, payment method, and delivery of the product subject to the contract on the internet site and has given the necessary confirmation electronically. Shopping can be done with credit card (VISA, MasterCard, American Express) or bank transfer. Orders for which a transfer is not made within one (1) business day are canceled. Orders will be processed not at the moment they are placed, but when the amount of money equal to the order amount is blocked from the credit card account or when the transfer reaches our accounts. Payment methods not specified in this article are strictly not accepted.

4.2 – The product subject to the contract shall be delivered to the BUYER or the person/organization indicated by the BUYER within the period specified in the preliminary information on the internet site, and at the location allocated to the BUYER for the Bosphorus Boat Show Land Exhibition to be held at the Istanbul Expo Center between February 17-24, 2024.

4.3 – If the product subject to the contract is to be delivered or presented to a person/organization other than the BUYER, the SELLER cannot be held responsible for the failure of the person/organization to accept the delivery or the product.

4.4 – The SELLER shall deliver the product orders subject to this Contract accompanied by a delivery note/invoice as required by law.

4.5 – The SELLER is responsible for delivering the product subject to the contract sound, complete, and in accordance with the qualifications specified in the order.

4.6 – For the delivery of the product subject to the contract, it is mandatory that the signed or approved copy of this contract is delivered to the SELLER and the price has been paid by the payment method chosen by the BUYER. If the product price is not paid for any reason or is canceled in the bank records, the SELLER is deemed to have been released from the obligation to deliver the product.

4.7 – If the SELLER cannot deliver the product subject to the contract within the due time due to force majeure or extraordinary circumstances such as adverse weather conditions preventing transportation or interruption of transportation, the SELLER is obliged to notify the BUYER of the situation. In this case, the BUYER may use one of the rights to cancel the order or postpone the delivery period until the hindering situation disappears. If the BUYER cancels the order, the amount paid shall be refunded in a lump sum within 30 days according to the payment method in the order.

4.8 – It is accepted that the company providing the product has duly fulfilled its duty after delivery. Therefore, any product found to be problematic during delivery must be reported to [email protected] with a report later on the same day.

4.9 – The SELLER shall start work related to the product order and ensure the delivery of the product by February 17, 2024, at the latest.

ARTICLE 5 – WITHDRAWAL

The BUYER has the right of withdrawal up to 15 days prior to February 17, 2024. To exercise the right of withdrawal, notification must be made to the SELLER via fax, e-mail, or telephone within this period, and the product must be unused. The refund to the consumer exercising the right of withdrawal shall be made by the SELLER within 30 business days.

ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED

The right of withdrawal cannot be exercised after the period specified in Article 5 of the contract.

ARTICLE 7 – AUTHORIZED COURT

In disputes arising from the application of this contract, the Consumer Arbitration Committees up to the value declared by the Ministry of Industry and Trade, and the Consumer Courts in the location of the SELLER are authorized.

(“Our Company” or “YATED”), we show utmost care for the processing and protection of personal data belonging to our visitors and Association members, who visit bosphorusboatshow.com, the official website of the Bosphorus Boat Show Sea Fair we organize, in accordance with the Law on the Protection of Personal Data numbered 6698 and its secondary regulations (“KVKK Legislation”).

Within the scope of our Company’s disclosure obligation arising from the KVKK legislation, we would like to inform you, our visitors of bosphorusboatshow.com, with this Bosphorus Boat Show Website KVKK Disclosure Text (“Disclosure Text”).

2. PERSONAL DATA

2.1. Definition of Personal Data

Pursuant to Article 3/I(d) of the KVKK, “personal data” refers to any information relating to an identified or identifiable natural person.   • Being relevant, limited, and proportionate to the purposes for which they are processed.

  • Retaining for the period stipulated by relevant legislation or required for the purpose for which they are processed.

2.3. Personal Data Processed by YATED

Upon visiting bosphorusboatshow.com, your personal data, primarily your traffic data, specified below, are processed by our Company in electronic and physical environments, in writing, through automated and non-automated methods, in a manner that is connected, limited, and proportionate to the purposes explained below, and in accordance with the KVKK legislation.

2.4. Purposes of Processing Personal Data

The Company may process personal data for the purposes stated below and may keep them for the duration required by these purposes and in any case for the durations required by legal regulations:

  • Processing online visitor data in accordance with the relevant legislation.

  • Execution of the ticket purchasing process by visitors through the Website.

  • Execution of ticket purchasing processes, negotiation, establishment, and performance of contracts concluded/intended to be concluded.

  • Improving the services offered through the Website, developing new services, and providing information regarding this.

  • For customers with commercial electronic communication consent: Analysis of Customer/Member preferences, tastes, and needs, and providing special promotions, opportunities, and benefits.

  • Within the scope of the contractual relationship, for customers with commercial electronic communication consent: Direct marketing, digital marketing, re-marketing, targeting, profiling, and analysis to promote and market applications, events, and services in line with the Customer/Member’s preference and taste.

  • Resolution of customer problems and complaints.

  • Contacting the Customer based on commercial electronic communication consent, and improving the Website Customer experience.

  • Creating customer/visitor satisfaction, loyalty, and commitment.

  • Tracking accounting and purchasing transactions.

  • Ensuring the security of the Company’s Website, and other electronic systems, social media accounts, and physical environments.

  • Ensuring compliance with legal processes and legislation.

  • Responding to information requests from administrative and judicial authorities.

  • Ensuring information and transaction security and preventing malicious use.

  • Conducting recruitment processes within the framework of human resources policies.

  • Making necessary arrangements to ensure that the processed data is current and accurate, and carrying out activities related to all the aforementioned processes.

  • Used for fulfilling the storage obligations arising from the law and other legislation.

2.3. Transfer of Personal Data

YATED may transfer the personal data obtained to third parties and process and store them in servers or other electronic media located in Turkey, provided that it complies with the general principles listed in the KVKK and the conditions stipulated in Articles 8 and 9 of the KVKK, and takes the necessary security measures, in line with the purposes specified in this Policy. The third parties to whom personal data may be transferred may vary depending on the type and nature of the relationship between the data owner and the Company (/user/membership relationship, busines1s relationship, etc.) and various other factors, but generally are as follows: (i) ED FUARCILIK as the Fair Organizer and Data Processor, (ii) YATED’s storage institutions, platform owners, data broadcasting institutions, infrastructure providers, and other business partners, suppliers, and subcontractors, (iii) all kinds of official authorities and institutions, (iv) banks and/or institutions authorized for collection for collection purposes and organizations worked with for the execution of the activity related to these purposes, and other relevant third parties.

 

2.4. Security and Audit of Personal Data

Within the framework of Article 12 of the KVKK, YATED, as the “data controller,” takes the necessary technical and administrative measures to ensure the appropriate level of security to prevent unlawful processing of personal data, unlawful access to data, and to ensure the preservation of personal data. For this purpose, (i) it is ensured that activities are carried out in accordance with the internal company policies and rules prepared for the protection of personal data, (ii) employees are given the necessary training and responsibilities regarding the personal data protection legislation and the internal Company policies and rules prepared in line with this, (iii) all necessary declarations and commitments are obtained from employees and individuals and institutions processing data on behalf of the Company regarding the confidentiality and protection of data, (iv) necessary information security measures are implemented to ensure the security of personal data inside and outside the Company and to prevent unauthorized access to data, (v) compliance with the internal policies and rules created for the protection of personal data is ensured, (vi) the adequacy of the measures taken is checked, and new data security systems are provided and/or existing data security systems are improved, updated according to needs and possibilities, and necessary audits are carried out in this regard.

2.5. Is your personal data transferred abroad?

Our Company does not transfer the personal data it collects through the website abroad.

2.6. Security and Destruction of Your Personal Data

Within the framework of Article 12 of the KVKK, YATED, as the “data controller,” takes the necessary technical and administrative measures to ensure the appropriate level of security to prevent unlawful processing of personal data, unlawful access to data, and to ensure the preservation of personal data. Our Company has a very high level of awareness regarding personal data security and privacy protection. In line with this, YATED processes the personal data of our visitors specified in this Disclosure Text by ensuring their security in accordance with the KVKK legislation, our Company’s KVKK Procedure, and the Personal Data Storage and Destruction Policy.

Your personal data is retained for the period necessary for the processing purposes specified in this Disclosure Text and in any case for the statutory limitation periods specified in the legal regulations. In the event that the aforementioned periods expire, YATED deletes, destroys, or anonymizes the personal data in line with the Personal Data Storage and Destruction Policy.

3. Your Right to Information

Within the scope of Article 11 of the KVKK, we inform you that by applying to our Company, you have the right to: (i) learn whether your personal data is processed; (ii) request information about the processing if it has been processed, learn the purpose of processing and whether it is used in accordance with its purpose, (iii) know the third parties to whom it is transferred at home/abroad, (iv) request correction if it is incomplete/incorrectly processed; (v) request its deletion/destruction within the framework of the conditions stipulated in Article 7 of the KVKK; (vi) request that the requests for deletion and destruction of personal data within the scope of Article 7 of the KVKK and the correction of incomplete/incorrectly processed personal data be notified to third parties to whom the personal data has been transferred; (vii) object to the emergence of a result against you due to its analysis exclusively by automatic systems, (viii) demand compensation for the damage if you suffer damage due to its unlawful processing.
